A statement released by the lawyer Sriram Panyam specifies that "In particular, our clients are proprietors of the Trade Mark DON BOSCO for 'EDUCATIONAL SERVICES INCLUDED IN CLASS 41' under Registration No. 1407313".
These Trade Marks are distinctive and are associated exclusively with our clients. They enjoy immense goodwill and reputation build over 100 years of imparting quality education.
By virtue of the above, our clients have the exclusive rights by themselves, their agents or licensees to apply and use the aforesaid Trade Marks or any other marks containing or comprising 'DON BOSCO' in India and elsewhere and no person, entity or institution has the right to apply to any services, particularly services covered under the International class 41, the aforesaid Trade Marks or any fraudulent imitation thereof or any Trade Marks which are deceptively similar thereto.
Please, therefore, take notice that any person, entity or educational institution providing or advertising any services and in particular educational services, having applied thereto our clients' aforesaid Trade Marks or any other Trade Marks which are deceptively similar thereto will be guilty of infringement of our clients' Trade Marks and also be guilty of "passing off". Our clients will not tolerate violation of their rights and will be entitled to institute appropriate legal action for injunction and damages against such person(s), entity / entities or any institutions.”
It should be noted that in India there are currently many organizations and institutions, active in education, which bear the name of Don Bosco even though they have nothing to do with the Salesians and the Salesian Family.
